(d) arising from international agreements for the protection of intellectual property which entered into force before the entry into force of the WTO Agreement, provided that such agreements are notified to the Ad Hoc Council and do not constitute arbitrary or unjustifiable discrimination against nationals of other Members. 3. Upon request, each Member shall consult with any other Member who has reason to believe that an intellectual property right holder, national or domicile of the Member to whom the request for consultation has been addressed is engaged in practices contrary to the laws and other laws of the requesting Member with respect to the subject matter of this Section. and who wishes to ensure compliance with this legislation, without prejudice to the measures provided for by law and the full freedom of final decision of either of the two members.
